1. SELLER IDENTITY

2. PURPOSE
These General Terms and Conditions of Sale ("GTC") govern all sales of jewelry offered by AUPIEL through its website, including in particular silver jewelry and 18-carat gold jewelry (750/1000), whether made to order or sold from stock. They apply exclusively to sales made to consumers (natural persons acting outside any commercial or professional activity). Any order implies the customer's full and unconditional acceptance of these GTC, the version in force being the one published on the website on the date the order is placed. AUPIEL reserves the right to amend these GTC at any time; the applicable terms are those accepted at the time of the order.
3. PRODUCTS
The jewelry offered consists of original creations designed by AUPIEL and manufactured by approved workshops. Gold jewelry is made of 18-carat gold (750/1000) and bears the legal hallmark of guarantee (eagle's head) as well as a brand-specific maker's mark. Photographs, visuals, and descriptions are provided for information purposes only and are not contractually binding. Slight variations may exist (shade, finish, weight), inherent to the artisanal process and the nature of precious metals; such variations cannot give rise to a claim.
4. PRICES
Prices are indicated in euros (€), all taxes included, excluding shipping costs, which are specified before validation of the order. Prices of jewelry made of precious metals take into account the market price of raw materials at the time of the order. Once the order is validated, the price is final. AUPIEL reserves the right to correct any obvious pricing error and to cancel any order affected by a manifest anomaly, in which case the customer will be informed and fully refunded.
5. ORDER
The order becomes final upon validation of payment. For made-to-order jewelry, production begins only after payment has been confirmed. AUPIEL reserves the right to refuse or cancel any order in the event of suspected fraud, incomplete or incorrect customer information, an abnormal order, or a pre-existing unresolved dispute with the customer. Where an order is cancelled by AUPIEL before production, the customer is refunded in full.
6. MADE-TO-ORDER PRODUCTION & LEAD TIMES
Jewelry made to order requires a minimum production time of six (6) weeks, to which shipping time is added. Lead times are indicative and may vary depending on the complexity of the piece, workshop workload, technical constraints, or events beyond AUPIEL's control. AUPIEL undertakes to inform the customer of any significant delay. In accordance with Article L.216-6 of the French Consumer Code, where delivery is significantly delayed, the customer may, after instructing AUPIEL to deliver within a reasonable additional period and failing performance within that period, cancel the order and obtain a refund of the sums paid; no further compensation may be claimed for reasonable delays.
7. DELIVERY
AUPIEL delivers internationally. All shipments are made with tracking. Gold jewelry may be shipped by secure, registered, or insured delivery. Delivery times vary according to the destination country and carrier. AUPIEL cannot be held responsible for delays attributable to the carrier, customs, or local authorities, beyond what the law imposes.
8. TRANSFER OF RISK – LOST OR DAMAGED PARCELS
In accordance with Articles L.216-4 and L.216-5 of the French Consumer Code, the risk of loss or damage is transferred to the customer at the moment the customer (or a third party designated by them, other than the carrier proposed by AUPIEL) takes physical possession of the goods. Where the customer entrusts delivery to a carrier of their own choosing, the risk is transferred upon handover to that carrier. All shipments are tracked. In the event of a parcel loss confirmed by the carrier after investigation, AUPIEL will, at its discretion, reship the item or issue a refund. AUPIEL declines all responsibility in the event of an incorrect or incomplete address provided by the customer, refusal of delivery, or failure to collect the parcel within the time limits set by the carrier.
9. RIGHT OF WITHDRAWAL & RETURNS
9.1 In-stock jewelry. In accordance with Articles L.221-18 et seq. of the French Consumer Code, the customer has a period of fourteen (14) days from receipt of the goods to exercise their right of withdrawal, without having to give reasons. To do so, the customer informs AUPIEL of their decision by an unambiguous statement (e.g. by email to contact@aupiel.fr), and may use the model withdrawal form reproduced at the end of these GTC. The item must be returned without undue delay and at the latest within fourteen (14) days following notification, unworn, undamaged, in perfect condition and in its original packaging. The direct cost of return shipping is borne by the customer. AUPIEL refunds all sums paid (excluding the supplementary cost arising from any express delivery option chosen by the customer) within fourteen (14) days of being informed of the withdrawal, and may withhold the refund until the goods are recovered or proof of dispatch is provided. AUPIEL reserves the right to reduce the refund to reflect any depreciation of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and proper functioning.
9.2 Made-to-order jewelry. In accordance with Article L.221-28 3° of the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalized. Such items cannot therefore be returned or refunded on the basis of a change of mind. This exclusion does not affect the customer's legal rights in the event of a manufacturing defect or non-conformity (see Article 10).
10. LEGAL WARRANTIES
Independently of any commercial gesture, all jewelry benefits from the legal warranty of conformity (Articles L.217-3 et seq. of the French Consumer Code) and from the warranty against hidden defects (Articles 1641 to 1648 of the French Civil Code). Under the legal warranty of conformity, the customer has two (2) years from delivery to obtain repair or replacement of a non-conforming item, free of charge and without depreciation; these legal warranties apply regardless of any commercial warranty and cannot be excluded or limited. To make a claim, the customer contacts AUPIEL at contact@aupiel.fr, where possible with photographs, ideally within a short time of discovering the issue. The legal warranties do not cover wear and tear resulting from normal use, damage caused by improper use or lack of care, impacts, scratches, oxidation or deformation occurring after delivery, or modifications and repairs carried out by a third party — none of which constitute a lack of conformity or a hidden defect.
11. LIABILITY
AUPIEL is bound by an obligation of means. AUPIEL's liability cannot be engaged for the improper use, mishandling, or insufficient care of the jewelry by the customer, nor for any event of force majeure. In accordance with applicable law, AUPIEL remains fully liable for damage resulting from a breach of its own obligations; nothing in these GTC limits the customer's legal rights or AUPIEL's liability where such limitation is prohibited by law.
12. FORCE MAJEURE
AUPIEL cannot be held liable for any failure or delay in performing its obligations resulting from an event of force majeure as defined by Article 1218 of the French Civil Code and French case law, including in particular natural disasters, fire, epidemics, strikes, transport or supply disruptions, shortage or sharp variation in the price of precious metals, or any other event beyond its reasonable control. The performance of AUPIEL's obligations is suspended for the duration of the event.
13. INTELLECTUAL PROPERTY
All AUPIEL creations, designs, 3D models, visuals, logos, and content are protected by intellectual property law and remain the exclusive property of AUPIEL. Any reproduction, imitation, adaptation, or exploitation, in whole or in part, without AUPIEL's prior written authorization, is strictly prohibited and may give rise to legal proceedings.
14. RESERVATION OF OWNERSHIP
The jewelry remains the full property of AUPIEL until complete payment of the price has been received, even though the risk is transferred to the customer upon delivery in accordance with Article 8.
15. PERSONAL DATA
Personal data collected is processed in accordance with the GDPR and with AUPIEL's Privacy Policy, available on the website, which sets out the purposes, legal bases, retention periods, and the rights of data subjects.
16. APPLICABLE LAW, CONSUMER MEDIATION & DISPUTES
These GTC are governed by French law.
In the event of a dispute, the customer is invited to contact AUPIEL first in order to seek an amicable solution.
In accordance with Articles L.612-1 et seq. of the French Consumer Code, after having contacted AUPIEL and in the absence of a satisfactory response, the customer may have free recourse to a consumer mediation procedure through the consumer mediator to which AUPIEL is affiliated:

The customer may also use the European Online Dispute Resolution (ODR) platform available at: https://ec.europa.eu/consumers/odr.
In the absence of such information being provided on the relevant communication media, and in accordance with Article L.641-1 of the French Consumer Code, any failure to comply with this information obligation may be subject to an administrative fine of up to €3,000 for a natural person and €15,000 for a legal entity.
Failing an amicable resolution, the competent courts shall be determined in accordance with the applicable rules of jurisdiction.
17. ACCEPTANCE
The customer acknowledges having read these General Terms and Conditions of Sale and accepts them without reservation prior to placing any order.
